2. Use of the Medways Cash & Carry Website

The Website is provided to you for your personal use subject to these Terms and Conditions. By using the Website you agree to be bound by these Terms and Conditions.

Although we aim to offer you the best service possible, we make no promise that the services at the Website will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Website you should report it tosales@medways.co.uk and we will attempt to correct the fault as soon as we reasonably can.

Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

3. Purchase of Products

We take all reasonable care in so far as is reasonably practical to keep the details of your order, personal information and payment secure, but in the absence of negligence on the part of Medways Cash & Carry we cannot be held liable for any loss the customer may suffer if a third-party procures unauthorised access to any data you provide when accessing or ordering form the website.

Order acceptance and the completion of the contract between the customer and us will take place on the despatch of the products ordered by the customer, unless we have notified you that we do not accept the order or you have cancelled it before the order is despatched. Despatch will only happen on cleared payment

The order for the Product is submitted once the customer clicks on the “Submit Order” button at the final stage of the buying process.

Medways Cash & Carry will send an order confirmation email acknowledging your order for a Product (s) within 24hrs of placing an order via the website, telephone or email. This is not confirmation that Medways Cash & Carry have accepted the order. Order acceptance and completion of the contract between Medways Cash & Carry and the customer will be completed immediately upon clearance of payment to Medways Cash & Carry and despatch of the ordered Product(s).

All orders are subject to availability of the Products.

4. Contract Cancellation and Returns

If you wish to exercise your right to cancel a contract prior to order despatch, please follow the procedure set out in the “Returns Policy”.

5. Description of Products

Each Product purchased is sold subject to its Product Description. We take pride in ensuring all details, descriptions and prices of Products appearing on our website are accurate at the time when the relevant information was entered onto the system. All photographs, colour, descriptive matter and specifications on our website are for the sole purpose of giving you the most accurate representation of the Product as possible.

Note: Products may be shown in locations and or with other products for stylistic and contextual purposes. These sets and styling products will not be included with the main product. Where appropriate, this will be clearly stated in writing adjacent to or as near to the relevant product as possible.

Although we aim to keep the Website as up to date as possible, the information, including Product Descriptions, appearing on this Website at a particular time may not always reflect the position at the exact moment you place an order.

Medways Cash & Carry reserve the right to withdraw any Products from the Website at any time and/or remove or edit any materials or content on the Website.

6. Payment

All prices are excluding VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery charges set out throughout the website and in the “Delivery” section of the website.

Customers can pay using any of the methods offered in the Check-Out section of the website including certain debit and credit cards, over the phone or via email. At this stage, the customer confirms that the credit or debit card that is being used is theirs.

All credit/debit card transactions are subject to validation checks and authorisation for payment by the card issuer. If the card issuer refuses to or does not authorise payment of the product(s), we will not be liable for any delay in delivery or non-delivery of the ordered product(s).

Medways Cash & Carry reserve the right to reject any offer of purchase by any customer at any time. Non-acceptance by Medways Cash & Carry of a customer order may be for reasons such as:

  • The product may be temporarily out of stock or unavailable for any reason (we will inform the customer by phone);
  • We cannot obtain bank authorisation for payment of the product(s);
  • The identification of a pricing or product description error (whilst we endeavour to provide up to date and comprehensive descriptions of our products, in this event, we will inform the customer directly by phone within 24hours of placement of the order);
  • The customer has not met the “Eligibility to Order from Medways Cash & Carry criteria set out in these Conditions (see below);
  • If we do not accept your order, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit or debit card or issue you a cheque for that amount as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

7. Eligibility to Order from Medways Cash & Carry

To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:

  • Register on the Medways Cash & Carry Website and consent to providing your real name, phone number, email address, payment details and other requested information;
  • Stipulate a delivery address in the United Kingdom. Please note that PO Box numbers, hotels and accommodation addresses are not accepted; and
  • Possess a valid credit or debit card issued by a bank acceptable to us.

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

8. Delivery

We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. We reserve the right to deliver in instalments. If we deliver in instalments you will be liable for only one delivery charge. You will inspect the Products at the place and time of delivery.

Delivery will be made as soon as possible after your order is accepted and in any event within 10 days of your order. However, you should note that delivery times are estimates only and while we will endeavour to avoid delay, we will not be liable to you for any loss or damage arising from delay in delivery.

You will become the owner of the Products you have ordered when they have been delivered to you. Once Products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

9. Liability

If the Products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing of the problem at our contact address within 3 working days of the delivery of the Products in question or within 3 months of delivery where there is a manufacturer’s defect.

If you do not receive Products ordered by you within 10 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing of the problem at our contact address within 40 days of the date on which you ordered the Products. If you notify a problem to us under this condition, our only obligation will be:

  • to make good any shortage or non-delivery;
  • to replace or repair any Products that are damaged or defective; or
  • to refund to you the amount paid by you for the Products in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 5 above.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Products from our site. The importation or exportation of certain of our Products to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Products you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

11. Applicable Law

These Terms and Conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you may do so within the United Kingdom.

12. Miscellaneous

You may not transfer any of your rights under these Conditions to any other person. We may transfer our rights under these Conditions to another business where we reasonably believe your rights will not be affected.

If you breach these Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Conditions.

We shall not be responsible for any breach of these Conditions caused by circumstances beyond our reasonable control.

If any provision of these terms and conditions or part thereof is found to be invalid or unenforceable, the invalidity or unenforceability of such provision or part will not affect any other provision or the remainder of the provision in which such invalid or unenforceable part is contained, which will remain in full force and effect.

Nothing in these terms and conditions will give nor is intended to give rights to any third party under the Contracts (Rights of Third Parties) Act 1999.
